⚠️ MyopiaTracker is a clinical decision-support tool — not a medical device. All clinical decisions remain the sole responsibility of the licensed clinician. Version 2.0 introduces a de-identified data registry and commercial analytics programme. See Section 7.
By accessing or using MyopiaTracker, you agree to be bound by these Terms of Use. If you do not agree, do not use this service. These Terms form a binding agreement between you and iCare Enterprises, LLC ("MyopiaTracker," "we," "us").
MyopiaTracker has two categories of authorised users:
MyopiaTracker does not permit direct accounts for children under 18. The Guardian Portal is for adult caregivers only. Children do not interact directly with the platform. This is intentional and reflects our paediatric privacy law obligations across all launch jurisdictions.
Clinicians are solely responsible for ensuring their use of MyopiaTracker complies with their professional obligations, applicable health regulations, and patient data handling requirements in their jurisdiction.
MyopiaTracker is an educational clinical decision-support tool. It does not constitute medical advice, diagnosis, or treatment. It is not FDA-cleared, CE-marked, TGA-registered, or approved by any regulatory body as a medical device. Growth curve projections, risk scores, and treatment comparisons are statistical estimates derived from published peer-reviewed studies and may not apply to every individual patient. Clinical judgment always supersedes tool output.
ℹ️ This section constitutes the Data Processing Addendum between the clinician (Data Controller) and iCare Enterprises, LLC (Data Processor) for the purposes of applicable data protection law in all launch jurisdictions, including the US, Australia, Singapore, Canada, India, Taiwan, Hong Kong, and Mexico.
When you enter patient data into MyopiaTracker, you (the Clinician) are the Data Controller — you determine the purpose and means of processing. iCare Enterprises, LLC is the Data Processor — we process data on your behalf, only for the purposes in these Terms and our Privacy Policy.
We store and process the clinical data you enter: patient demographic information (age band, sex, ethnicity where permitted by jurisdiction), axial length measurements, refractive data, treatment records, visit notes, and guardian compliance logs linked to your patients.

We will notify you of material changes to sub-processors by updating these Terms and emailing your registered account address.
The Guardian Portal is for adult parents and caregivers only. By creating a Guardian account, you confirm you are 18 or older and are the parent or legal guardian of the child whose data you are logging.
Guardians log daily health behaviour data: outdoor time, screen and near work time, eye drop compliance, and contact lens wear. This is linked to the child's clinical record held by the treating clinician.
Guardians may delete their account and all associated logs at any time by emailing support@myopiatracker.com. Deletion of guardian logs does not delete the clinical record maintained by the clinician.
Guardians are separately invited to opt in to registry participation. This is voluntary, independent of the clinical service, and revocable at any time. See Section 7.
Paid subscriptions are processed by Stripe, Inc. Fees are billed in advance and are non-refundable except where required by applicable consumer law. You may cancel at any time; cancellation takes effect at the end of the current billing period. Plan features and pricing are at myopiatracker.com/pricing and may be updated with 30 days notice to registered users.
On deletion request we will: (a) make your patient data available for export in JSON/CSV; (b) delete your clinician account and auth record; (c) flag patient records for retention for 7 years from last clinical visit, then permanently delete. This matches medical record retention requirements in most launch jurisdictions.
Guardian daily logs are deleted within 30 days of account deletion request. The clinical patient record held by the treating clinician is not affected.

On revocation of registry consent, no further records are generated. Previously submitted de-identified records are flagged for exclusion from future aggregate analyses. Aggregate reports previously delivered to sponsors or published as research outputs are not retractable. Individual records are never identifiable in such outputs.
⚠️ Participation in the registry is entirely optional and separate from the clinical service. You can use MyopiaTracker fully without participating.
MyopiaTracker operates an optional global de-identified paediatric myopia registry for epidemiological research, clinical benchmarking, and normative reference data development.
When both the clinician's practice and the relevant guardian have provided registry consent, the following de-identified fields are collected per visit:

Visits are linked by a scoped one-way cryptographic token that cannot identify the patient and rotates on consent version change.
De-identified aggregate registry data may be used for commercial purposes including: aggregate research and market intelligence reports for pharmaceutical companies, medical device manufacturers, and lens producers; Health Economics and Outcomes Research (HEOR); Real-World Evidence (RWE) products; predictive analytics and AI model development within MyopiaTracker; and peer-reviewed academic publication of aggregate findings.
No individual patient record is ever sold or provided to any third party. Only aggregate statistics that cannot be linked to any individual or clinic are used for commercial purposes.
Data from clinicians in the People's Republic of China and the Russian Federation is not collected in the registry. These clinicians may use the clinical service normally.
Clinician consent is managed via the Consent tab in the app. Guardian consent is managed via the Guardian Portal. Both are required for a patient's data to enter the registry. Either party may revoke at any time.
When a child reaches 18, registry exports from their record are automatically suspended pending their own adult consent, which is not yet supported in Phase 1.
All content, code, design, and data compilations are © 2026 iCare Enterprises, LLC. The de-identified registry dataset and derivative analytics products are the intellectual property of iCare Enterprises, LLC. Clinical data you enter about your own patients remains your data. You grant iCare Enterprises, LLC a licence to process it for the purposes in these Terms, including registry extraction where consent is given.
MyopiaTracker is provided "as is" without warranties of any kind. iCare Enterprises, LLC shall not be liable for any direct, indirect, incidental, or consequential damages from use of or reliance on MyopiaTracker, including clinical outcomes. Maximum aggregate liability shall not exceed total fees paid in the preceding 12 months, or USD $100, whichever is greater.
These Terms are governed by the laws of the State of Arizona, United States. Disputes are subject to the exclusive jurisdiction of courts in Maricopa County, Arizona. Nothing limits rights you may have under mandatory consumer or data protection law in your jurisdiction.
We will update the version number and date when Terms change and notify registered users by email at least 14 days before changes take effect. If changes affect registry consent, existing consents will be set to Pending Re-consent and data exports will pause until re-consent is provided.
